Jury selection got underway Tuesday for the re-trial of a Cranbrook man accused of raping a local woman.
Matthew Allen Buxton is charged with sexual assault and choking to overcome resistance in relation to an October 2016 incident.
The case initially went to court in September of last year, but was declared a mistrial after the first jury was allowed to listen back to evidence without the court’s knowledge during deliberations.
Six days have been set aside for the new hearing.
Testimonies from witnesses and the alleged victim will have to be done again once the new jury is selected.
